{"id":17869,"date":"2023-12-21T17:01:49","date_gmt":"2023-12-21T16:01:49","guid":{"rendered":"https:\/\/londoncult.co.uk\/?p=17869"},"modified":"2023-12-21T17:01:49","modified_gmt":"2023-12-21T16:01:49","slug":"banks-to-start-returning-money-to-fraud-victims","status":"publish","type":"post","link":"https:\/\/londoncult.co.uk\/en\/banks-to-start-returning-money-to-fraud-victims\/","title":{"rendered":"Banks to Start Returning Money to Fraud Victims"},"content":{"rendered":"<p class=\"s3\"><span class=\"s4\" style=\"letter-spacing: 0em;\"><span class=\"bumpedFont15\">On December 19th, the Payment Systems Regulator (PSR), an <\/span><\/span><span class=\"s4\" style=\"letter-spacing: 0em;\"><span class=\"bumpedFont15\">organisation<\/span><\/span><span class=\"s4\" style=\"letter-spacing: 0em;\"><span class=\"bumpedFont15\"> overseeing banking operations, made a historic <\/span><\/span><a style=\"letter-spacing: 0em;\" href=\"https:\/\/www.psr.org.uk\/news-and-updates\/latest-news\/news\/psr-confirms-new-requirements-for-app-fraud-reimbursement\/\" rel=\"nofollow noopener\" target=\"_blank\"><span class=\"s5\"><span class=\"bumpedFont15\">decision<\/span><\/span><\/a><span class=\"s4\" style=\"letter-spacing: 0em;\"><span class=\"bumpedFont15\">: starting from October 7th, 2024, banks will be obligated to refund funds to victims of <\/span><\/span><span class=\"s4\" style=\"letter-spacing: 0em;\"><span class=\"bumpedFont15\">authorised<\/span><\/span><span class=\"s4\" style=\"letter-spacing: 0em;\"><span class=\"bumpedFont15\"> Push Payment frauds (APP). This move comes in response to the increasing incidents of user deception through applications, resulting in substantial financial losses.<\/span><\/span><\/p>\n<p class=\"s3\"><span class=\"s4\"><span class=\"bumpedFont15\">Currently, banks are not required to reimburse stolen funds, although some voluntarily adhere to a <\/span><\/span><a href=\"https:\/\/www.moneysavingexpert.com\/news\/2019\/05\/more-protection-for-money-transfer-scam-victims-from-today\/\" rel=\"nofollow noopener\" target=\"_blank\"><span class=\"s5\"><span class=\"bumpedFont15\">code<\/span><\/span><\/a><span class=\"s4\"><span class=\"bumpedFont15\"> established in 2019. According to the latest data from PSR, only 64% of funds lost due to application fraud were returned to victims in the first half of 2023.<\/span><\/span><\/p>\n<p class=\"s3\"><strong><span class=\"s4\"><span class=\"bumpedFont15\">Here are the key aspects of the new regulations:<\/span><\/span><\/strong><\/p>\n<p class=\"s3\"><span class=\"s4\"><span class=\"bumpedFont15\">1. <\/span><\/span><span class=\"s6\"><span class=\"bumpedFont15\">Swift Refunds: <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">Victims reporting fraud to the bank can expect reimbursement within 5 working days. In more complex cases requiring additional evidence or inquiries, banks have up to 35 working days to process the request.<\/span><\/span><\/p>\n<p class=\"s3\"><span class=\"s4\"><span class=\"bumpedFont15\">2. <\/span><\/span><span class=\"s6\"><span class=\"bumpedFont15\">Additional Fees: <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">Banks have the discretion to charge additional fees up to <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">\u00a3<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">100 for each request. This means that if the damage is less than <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">\u00a3<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">100, the money may not be refunded, except in cases where the victim falls into a &#8220;vulnerable category.&#8221; Despite consumer advocacy groups, including MoneySavingExpert.com, opposing fixed fee amounts, the PSR has upheld this decision, believing it will encourage customers to remain vigilant when making payments.<\/span><\/span><\/p>\n<p class=\"s3\"><span class=\"s4\"><span class=\"bumpedFont15\">3. <\/span><\/span><span class=\"s6\"><span class=\"bumpedFont15\">Maximum Refund Amount: <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">The maximum refund per request is <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">\u00a3<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">415,000. PSR acknowledges the complexity of setting a uniform threshold and remains open to adjusting the amount in the future.<\/span><\/span><\/p>\n<p class=\"s3\"><span class=\"s4\" style=\"letter-spacing: 0em;\"><span class=\"bumpedFont15\">4. <\/span><\/span><span class=\"s6\" style=\"letter-spacing: 0em;\"><span class=\"bumpedFont15\">Exceptions: <\/span><\/span><span class=\"s4\" style=\"letter-spacing: 0em;\"><span class=\"bumpedFont15\">Compensation will not be provided if the bank determines that the victim displayed &#8220;gross negligence.&#8221; To be eligible for a refund, individuals must prove that they heeded their bank&#8217;s warnings, reported fraud promptly, shared all necessary information, and agreed to provide information about the fraud to the police.<\/span><\/span><\/p>\n<p class=\"s3\"><span class=\"s4\" style=\"letter-spacing: 0em;\"><span class=\"bumpedFont15\">5. <\/span><\/span><span class=\"s6\" style=\"letter-spacing: 0em;\"><span class=\"bumpedFont15\">Protection Measures for &#8220;Vulnerable&#8221; Customers: <\/span><\/span><span class=\"s4\" style=\"letter-spacing: 0em;\"><span class=\"bumpedFont15\">These are individuals particularly susceptible to &#8220;the risk of falling victim to fraud due to personal circumstances.&#8221; Such bank customers will receive additional protection, including exemption from fees and the application of &#8220;negligence standards.&#8221; Banks plan to assess the degree of &#8220;vulnerability&#8221; on a case-by-case basis.<\/span><\/span><\/p>\n<p class=\"s3\"><span class=\"s4\" style=\"letter-spacing: 0em;\"><span class=\"bumpedFont15\">Despite the new rules taking effect in the new year, consumers are advised to remain vigilant and promptly report fraud, with corresponding <\/span><\/span><a style=\"letter-spacing: 0em;\" href=\"https:\/\/www.moneysavingexpert.com\/shopping\/stop-scams\/\" rel=\"nofollow noopener\" target=\"_blank\"><span class=\"s5\"><span class=\"bumpedFont15\">instructions<\/span><\/span><\/a><span class=\"s4\" style=\"letter-spacing: 0em;\"><span class=\"bumpedFont15\"> already prepared.<\/span><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>On December 19th, the Payment Systems Regulator (PSR), an organisation overseeing banking operations, made a historic decision: starting from October 7th, 2024, banks will be obligated to refund funds to victims of authorised Push Payment frauds (APP).
